A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.

The situation originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer human smuggling allegations, he was detained in immigration detention.

In her order, the judge pointed out that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
